Recognition of a Palestinian state could, in theory, lead to Israeli officials being dragged repeatedly before the International Criminal Court in the Hague for claims regarding its settlement policies in the West Bank, legal experts say.

According to the statute of the court, the direct or indirect transfer of an occupier’s population into occupied territory constitutes a war crime.

Attorney Nick Kaufman and Prof. Daphne Richmond-Barak, both international law experts who have worked with the International Criminal Court, believe the Palestinians will certainly try. They may even ask the court to investigate incidents that occurred before 2002, which is when the court began operating, even though as a rule, such claims are not accepted, says Richmond-Barak. "The chances that Israelis will find themselves in court in the Hague will be much greater after September," she said.

lol Are they going to bring Hamas into the Hague too? Half the UN belongs on trial in the Hague including the United States.

    Whichever country's representative files charges at the Hague, should receive immediate military strike from Israel. The only thing some of these countries recognize and respect is force. They need to be brought to heel. There is no such thing as a Palestinian homeland. There is no, repeat no history that supports it. It's a made up story by the Arab community because they do not wish to give up any of their territory for a palestinian state. The Israelis have tried the cooperate & negotiate. Never works with Arabs. Time to quit negotiating.

    In 1948 the UN partitioned what was left of the mandate to Israels detriment, though it had no right to do so. The Arab inhabitants enlisted the armies encircling the mandate lands to come and kill the Jews, drive them out, get rid of em. They lost and the war stopped at what is called the 1948 armistice lines.

    Jordan and Egypt meanwhile took possession of lands east of the Jordan river and Gaza respectively. From 1948 to 1967 their were no negotiations by the Arabs residing under Egyptian and Jordanian rule to relinquish said territories to its inhabitants in order to setup some sort of sovereign state. They accepted Jordanian citizenship and held Jordanian passports.

    In 1967 when Israel acquired the territories east of the Jordan from Jordan, due to Jordan's unnecessary intervention in Israels per-emptive strike against Egyptian and Syrian armies who had created a casus belli on the border, Jordan lost these lands. They are not Occupied by Israel, Jordan renounced claims to the lands and the Arab residents up to that point never seemed too bothered to ask Jordan to help them set up a Govt. Its obvious that the lands are spoils of war, taken from an enemy and consisting of a group of people who never until then lobbied for their own state and so it became obvious that due to their racist views of Jews that they now decided they had to have a State where they could be free of Jews since they were Arabs first and last. Sovereignty was never a concern nor of importance..

    Israel established settlements with the willingness of the people moving there and not transferred forcibly, nor deported there without choice in the matter. The Hague can kiss Israels azz since it has no leg to stand on and in fact may give Israel a forum to prove legally from the beginning of the San Remo resolution till today that in fact, the Arabs demanding a sovereign nation have no standing, nor merit.

      Again why do Israelis like to act as the judge jury and prosecutors of the whole world.

      It's the "Master Race" syndrome, same one the Nazis suffered from.
